1. Acceptance of Terms

By creating an account, accessing, or using the Contatinhos application ("Application", "Service", "we", "our"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legal agreement between you and the operators of Contatinhos.

If you do not agree with these Terms, you must not use the Application. Use of the Application constitutes your acceptance of these Terms.

2. Eligibility and User Responsibility

2.1. Minimum Age

You must be at least 18 (eighteen) years old to use the Application. By using the Application, you declare and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into this agreement;
• You are not prohibited from using the Application under applicable laws;
• You have not been previously banned from the Application for violating these Terms.

2.2. Responsibility for Behavior

YOU ARE FULLY RESPONSIBLE FOR YOUR OWN BEHAVIOR AND INTERACTIONS ON THE APPLICATION. Contatinhos acts solely as an intermediary platform that connects users. We are not responsible for:

• The content of messages, photos, or information shared by you or other users;
• The actions, conduct, or behavior of other users;
• Any physical, emotional, financial, or other damage resulting from interactions between users;
• In-person meetings or relationships formed through the Application;
• Any loss, theft, or damage to personal property during meetings;
• Any illegal activity conducted by you or other users.

3. Acceptable Use and Prohibitions

3.1. You agree NOT to:

• Use the Application for any illegal or unauthorized purpose;
• Create false, fraudulent, or deceptive accounts;
• Use another person's information or impersonate another person;
• Share content that is defamatory, slanderous, obscene, pornographic, violent, threatening, harassing, discriminatory, or that violates third-party rights;
• Send spam, unsolicited messages, commercial or unauthorized advertising content;
• Use the Application to harass, intimidate, threaten, stalk, or cause harm to other users;
• Collect information from other users for commercial or unauthorized purposes;
• Use bots, automated scripts, or any method to manipulate the Application's functioning;
• Attempt to access other users' accounts or Application systems without authorization;
• Interfere, disrupt, or harm the Application's operation or servers;
• Use the Application for prostitution, human trafficking, or any related illegal activity;
• Share contact information (phone, email, social media) before establishing mutual trust;
• Use the Application for fraud, scams, or deception;
• Violate any applicable local, state, national, or international law.

3.2. User Content

You are solely responsible for all content you post, send, transmit, or share through the Application, including but not limited to:

• Profile photos and images;
• Biography and profile information;
• Messages sent to other users;
• Any other content generated by you.

You warrant that you have all necessary rights to the content you share and that such content does not violate third-party rights.

4. Moderation and Content Removal

We reserve the right, but not the obligation, to:

• Monitor, review, edit, remove, or refuse any content on the Application at our sole discretion, without prior notice;
• Remove or disable accounts that violate these Terms;
• Investigate reports of inappropriate or illegal behavior;
• Cooperate with legal authorities when necessary.

We do not guarantee that we will monitor or remove all inappropriate content. Responsibility for appropriate behavior lies with the user.

5. Reports and Blocks

You may report users who violate these Terms or behave inappropriately. We will investigate good faith reports, but:

• We do not guarantee immediate or specific action on reports;
• We reserve the right to take or not take measures at our discretion;
• You may block other users at any time;
• Blocked users will not be able to see your profile or contact you.

6. Subscriptions and Payments

6.1. Subscription Plans

The Application offers different subscription plans (FREE, VIP, PREMIUM, UNLIMITED) with varying features. By subscribing to a paid plan:

• You agree to pay all fees associated with the chosen plan;
• Subscriptions are automatically renewed unless cancelled;
• You are responsible for cancelling your subscription before renewal if you do not wish to continue;
• Refunds are handled according to the policies of the app store or payment processor used for the purchase;
• We do not guarantee refunds after service use.

6.2. Credits and Features

The Application may offer a credit system. Credits:

• Are non-refundable and non-transferable;
• May expire as defined in our policies;
• Have no real monetary value;
• May be modified or removed at any time without prior notice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTATINHOS AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages;
• Loss of data, revenue, profit, or business opportunity;
• Damages resulting from in-person meetings or relationships formed through the Application;
• Damages resulting from misuse of the Application by you or other users;
• Interruptions, errors, bugs, or failures in the Application;
• Actions or omissions of other users;
• Any user-generated content;
• Privacy or security violations caused by other users;
• Any loss or damage resulting from your failure to maintain the security of your account.

YOU USE THE APPLICATION AT YOUR OWN RISK. You are responsible for taking all necessary precautions when interacting with other users, including but not limited to:

• Verifying the identity of other users before in-person meetings;
• Meeting in public and safe locations;
• Informing friends or family about your meetings;
• Not sharing sensitive financial or personal information;
• Reporting suspicious or inappropriate behavior immediately.

8. Indemnification

You agree to indemnify, defend, and hold harmless Contatinhos, its operators, employees, partners, and affiliates from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including attorney's fees) arising from:

• Your use of the Application;
• Your content or behavior on the Application;
• Your violation of these Terms;
• Your violation of any third-party rights;
• Any illegal activity conducted by you through the Application.

9. Intellectual Property

The Application, including its design, code, logos, trademarks, and content (except user content), is the property of Contatinhos and is protected by intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works of the Application without authorization;
• Use our trademarks or logos without permission;
• Copy, disassemble, or reproduce the internal operation of the Application.

You retain all rights to the content you create and share, but grant Contatinhos a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Application.

10. Privacy

Your use of the Application is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Application, you agree to our Privacy Policy.

11. Account Termination

You may terminate your account at any time through the Application settings. We may, at our sole discretion and without prior notice, suspend or terminate your account if:

• You violate these Terms;
• You engage in fraudulent or illegal activity;
• You use the Application in a way that causes harm to us or other users;
• For any other reason at our discretion.

Upon termination, your right to use the Application will cease immediately. We may retain your data as necessary to comply with legal obligations or resolve disputes.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the Application or by email. Your continued use of the Application after such modifications constitutes your acceptance of the revised Terms.

If you do not agree with the modified Terms, you must stop using the Application and terminate your account.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Brazil. Any dispute related to these Terms or the Application will be resolved in the competent courts of Brazil.

14. General Provisions

14.1. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force.

14.2. Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

14.3. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Contatinhos regarding the use of the Application.
